Validity

All deliveries, services, and offers from Pryme Fitness in the Pryme Fitness online shop are made exclusively on the basis of these general terms and conditions. They form part of all contracts that Pryme Fitness concludes with customers for the products offered in the Pryme Fitness online shop. Pryme Fitness does not recognize any deviating terms and conditions of the customer unless Pryme Fitness has expressly agreed to their validity in writing.

• Performance
  You can order all items for private use online via the “Pryme Fitness” webshop. Orders for commercial purposes are excluded.
• Language of the contract
  The language of the contract is French.
• Conclusion of contract / ordering process
  The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalog. By clicking the “Buy” button, you place a binding order for the goods contained in the shopping cart. Receipt of your order is confirmed with the acceptance of the order immediately after its dispatch by automated e-mail. With this e-mail confirmation, the purchase contract is concluded. • Right of withdrawal
  As a consumer, you have the right to return the goods received as follows.

  Right of withdrawal II
  You have the right to withdraw from this contract within 30 days without giving any reason. The withdrawal period is 30 days from the day on which you or a third party named by you who is not the carrier took possession of the goods.

  In case of cancellation, the goods must be returned in their original condition with all labels and in the packaging provided. The following are excluded from the right of return (but not from warranty rights):

• Underwear, swimwear, etc.
  To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g. a letter sent by post or email) about your decision to withdraw from this contract. You can fill out the withdrawal form electronically in your user account or send us another clear statement. If you use our form, we will immediately confirm receipt of such a revocation by email.
• Livraison / Transport
  La livraison sera effectuée à l’adresse de livraison que vous avez indiquée. Si possible, vous recevrez votre commande en un seul envoi. Si une expédition séparée s’avère nécessaire pour des raisons techniques ou logistiques, par exemple parce que votre commande contient des articles qui doivent être emballés séparément ou transportés différemment, vous n’aurez pas à supporter de frais supplémentaires en conséquence. En cas de paiement anticipé, les délais de livraison spécifiés s’appliquent à compter de la réception de l’argent sur notre compte. La livraison a lieu dans un délai de 2 à 5 jours ouvrables. Les marchandises sont livrées par DPD, selon la méthode d’expédition que vous sélectionnez dans le processus d’achat. En choisissant un expéditeur, vous acceptez ses termes et conditions.
• Remise du Colis
  À l’exception de la livraison dans un Endroit Sûr, l’Expéditeur peut exiger, si cela est requis dans le Pays d’expédition et le Pays de livraison, que le Destinataire du Colis soit majeur, qu’il signe l’ESCD ou tout autre document requis, ou qu’il fournisse un code PIN, comme preuve de la remise du Colis. L’Expéditeur et le Destinataire acceptent la confirmation de réception du Colis à l’aide d’un appareil électronique et n’ont pas droit à des réclamations concernant la confirmation de la livraison du Colis obtenue à l’aide de cet appareil. Tout enregistrement de la signature du Destinataire ou du code PIN sera considéré comme une preuve suffisante de la remise du Colis. En cas de livraison dans un Endroit Sûr, un enregistrement scanné sera considéré comme preuve de la remise du Colis. Le Colis est remis au Destinataire ou à toute autre personne se trouvant à l’adresse de livraison du Destinataire, l’Expéditeur n’étant pas tenu de vérifier si cette personne est effectivement autorisée à recevoir le Colis. L’Expéditeur peut demander certaines informations ou une pièce d’identité de cette personne lors de la livraison. Si le Colis doit être livré à un Voisin, dans un Endroit Sûr ou à une Adresse de repli, le Livreur n’est plus tenu de vérifier si le Destinataire est bien autorisé à recevoir le Colis à cette adresse de repli, et cette personne sera considérée comme autorisée. Si le Colis est livré à un hôtel, un hôpital, une université, un bureau gouvernemental ou d’autres bâtiments disposant d’une salle de courrier ou d’une réception centrale, le Colis peut être livré à cet endroit, à moins qu’un autre accord n’ait été pris avec l’Expéditeur avant l’envoi du Colis.
• Return of Goods
  You must return the goods without undue delay and in any event no later than 14 days from the day you notify us of the cancellation of this contract. The customer shall bear the costs of return shipping. An exception applies only to complaints. If your complaint is accepted, we will bear the direct costs of returning the goods.
• Consequences of revocation
  If you withdraw from this contract, we will reimburse you for all payments we have received from you, including delivery costs, within 14 days from the day on which we received notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless something else has been expressly agreed with you; in no event will you be charged a fee for this reimbursement. We may refuse reimbursement until we have received the returned goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
• Delivery Scope
  Delivery is possible to all countries in the European Union. Delivery costs for each destination are specified at the time of ordering. If the customer has agreed with the delivery company to allow the delivery to be left at another location (in front of the front door, apartment door, garden, etc.), the delivery company and the seller decline all liability in the event of loss.
• Payment
  You can choose between different payment methods at Sportega sro. For more information on this topic, see the Payment section. With us, you can easily pay with VISA, MasterCard and American Express credit cards. Payment is made on behalf of PayPal. The customer agrees that his address and bank details (name, address, telephone number, IBAN and BIC) may be transmitted for collection, processing and use for the purpose of processing transactions and may be transmitted by them to third-party companies, as long as this is necessary for processing payment transactions.
• Retention of title
  The goods remain the property of Sportega sro until full payment of the purchase price.
• Warranty
  In the event of defects in the delivered goods, statutory rights apply. However, the special provisions of Section 11 apply to claims for damages.
• Liability
  Unless otherwise stated below, claims for damages by the customer are excluded, regardless of their legal basis. This exclusion of liability does not apply in the event of personal injury or damage caused by intent or gross negligence or breach of essential contractual obligations. This also does not apply if there are guaranteed quality characteristics or if there is a claim under the Product Liability Act.

  If Pryme Fitness is liable due to a negligent breach of a contractual obligation, liability for material damage is limited to foreseeable damage typical of the contract.

  To the extent that the liability of Pryme Fitness is excluded or limited, this also applies to the liability of Pryme Fitness’s legal representatives or vicarious agents.

• Links / Copyright
  Insofar as Sportega sro provides links to other websites, Sportega sro expressly points out that these are third-party contents for which Sportega sro cannot assume any liability. The linked pages were checked for possible legal violations at the time they were linked, but no such violations were recognizable. However, continuous monitoring of the linked pages without concrete evidence is not reasonable. If Pryme Fitness becomes aware of any legal violations, it will of course remove the corresponding links immediately.

  Copyrighted content, in particular images, texts, design, etc., may not be used without the prior written consent of Pryme Fitness, and in particular may not be duplicated or published in any other way.

• Data Protection
  Your orders and the order data you enter will be stored by Pryme Fitness. All data we collect is used and processed exclusively within the framework of applicable data protection laws.
• Severability clause, applicable law, mandatory consumer protection rules, place of jurisdiction, out-of-court dispute resolution
  (1) If individual provisions of these General Terms and Conditions of Sale are wholly or partially invalid or inapplicable or become invalid or inapplicable after the conclusion of the contract, the validity of the remaining provisions shall not be affected.

  (2) Contracts concluded between us and customers on the basis of these General Terms and Conditions of Sale are governed by French law, excluding the United Nations Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the law of the country in which the consumer customer has his habitual residence remain unaffected by this provision. A consumer is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to either his commercial or his independent professional activity.

  (3) The exclusive place of jurisdiction for all disputes arising from this contract is our registered office (currently Brno, Czech Republic) if the customer is a merchant or if the customer does not have his place of general jurisdiction in the same country as the contracting Sportega company.

  (4) The European Commission provides consumers with an online dispute resolution (ODR) platform. 

  (5) We are neither obliged nor willing to participate in a dispute resolution procedure under the Consumer Dispute Settlement Act (VSBG).

• Miscellaneous
  If any of these provisions is or becomes invalid, this will not affect the validity of the remaining provisions.
